MINUTES OF THE FREEDOM BOARD OF APPEALS
Thursday January 11, 2007 at 6:30 PM

ANNUAL ORGANIZATIONAL MEETING

Present: Addison Chase, Lissa Widoff, Mike Smith, Frances Walker, and Peter Bowers.

Elections of officers took place. Addison Chase was elected Chairperson; Lissa Widoff, Acting Chair; Frances Walker, Secretary.

Copies of the CES project application, letter dated January 4 from Rudman & Winchell (representing Jason Wade and Erin Bennett-Wade and Judy and Steve Bennett) and included site plan were distributed to individual Appeals Board Members. Also distributed was a second letter dated January 5 from Rudman & Mitchel requesting other residents (listed on separate page) be included as appellants in the appeal of the Planning Boards approval of the CES application.

A date was set for another meeting Tuesday January 16 at the Town Office. Addison will send a 48 hour written notice to each member of the Appeals and Planning Boards, each Selectperson and the Code Enforcement Officer. At that meeting the Appeals Board will set the date for the upcoming CES hearing and discuss whether or not the Board will also need a lawyer present on its behalf. A question was asked about which ordinance governs this appeals process. Since there is an appeals procedure in the Commercial Development Review Ordinance as well as one in the Board of Appeals Ordinance, Addison said that we were required to use the more restrictive provisions.
